Ethical Dilemma Project: Peer Review

This week you will share your Introduction and Background of the Case with your fellow students, and then you will provide peer feedback to the responses of two other students.

follow this format:

Introduction

Tell us about your topic and chosen case. Why did you choose this particular case? Why is it important to you? Why should other people care about it too? What ethical dilemma does it raise?

Background of the Case

Use the reporter’s questions to tell us about the background of your case. Who was involved? When and where did it happen? How and why did it happen? Which ethical theory is best suited to the ethical dilemma’s raised by your case?

You may write your introduction and background straight into the discussion area–no need for an attachment. Use bold headings just like you see above, and then answer the questions in complete sentences. The introduction and background should each consist of a well-developed paragraph.

After you have made your initial post, you will then respond to two other students based on the legal and ethical issues raised by their cases.

Legal Issues

Identify the legal issues (e.g., specific laws or rules) that were violated or that might have arisen or that could have been invoked (Constitutional law, statutory law, administrative law, case law, common law, civil law, criminal law, national law, international law). Name or list specific laws that apply or that you think might to the case. Cite all sources using APA documentation style.

Ethical Dilemma: Cyberloafing Student Name : University : Course : Ethical Dilemma: Cyberloafing The topic that I have chosen is cyberloafing. It involves employees using the internet at their place of work, during working hours, to conduct activities that are not related to their work. For example, cyberloafing could occur when employees perform shopping or use social media platforms during work time. I have chosen this topic because of the prevalence of instances of cyberloafing among employees. It is not uncommon to find employees placing their orders during online shopping or chatting with a friend during work time. Most of the employees are unaware of the thin line between rejuvenating and wasting time during work time. I thus sought to explore this topic to show the difference between rejuvenating and wasting precious company time. People should care about cyberloafing because of its prevalence in today’s world. According to Kalejaiye and Hammed (2021), a survey conducted by Vault.com indicated that “88% of employees surf non-work-related websites during working hours and 66% surf between 10 minutes and one hour”. This is a major concern for businesses because of the amount of time wasted. There are some researchers that claim that small amounts of cyberloafing are actually good for the employees although other researchers claim that cyberloafing is actually a bad habit, just like procrastination at the workplace. People should thus care about the topic of cyberloafing because it could be beneficial in helping the employees take quick breaks that allow their brains to re-calibrate between tasks which could help to alleviate work stress. However, it is also argued that cyberloafing is a waste of productive company time and could pose security risks to the business. The business challenge that is posed by cyberloafing is that cyberloafing allows the employees to flood the computing resources at work for their personal use. This could lead to clogging of the company’s bandwidth and potential degradation of the system performance. Other business challenges that are posed by cyberloafing include increased instances of security risks, reduced productivity among the employees, and increased risks of computer malware and viruses (Kalejaiye & Hammed, 2021). It is thus evident that cyberloafing causes numerous challenges to the business. The purpose of this paper will be to explain the benefits of cyberloafing in allowing the employee’ brains to re-calibrate between tasks which could help to alleviate work stress, while cyberloafing could pose challenges in clogging of the company’s bandwidth and causing potential degradation of the system performance, increasing security risks, reducing productivity among the employees, and increasing risks of computer malware and viruses. Peer responses John Hello Class and Professor, Tell us about your topic and chosen case. Why did you choose this particular case? Why is it important to you? Why should other people care about it too? What ethical dilemma does it raise? Introduction The topic I have chosen is Diversity, Equity and Inclusion in the Workplace. To highlight my topic of choice, I have given a real world case as an example of the impact unethical practices in the workplace, can have on everyone. My case is Juarez Vs. AutoZone Stores LLC. It was a(n) pregnancy discrimination case in which the company was exposed for more than just this form of discrimination. I believe everyone should care about these forms of discrimination as they can impact anyone. There are so many different forms and they are so easily concealed or hard to prove. The ethical dilemma in this case is simple, gender discrimination, can never be justified. At this point in humanity, these are the short comings that hold us back as a society. _________________________________________________________________________________________________________________________________ Use the reporter’s questions to tell us about the background of your case. Who was involved? When and where did it happen? How and why did it happen? Which ethical theory is best suited to the ethical dilemma’s raised by your case? Background of the Case The two parties involved in my example case are a woman named Rosario Juarez and the company AutoZone Stores LLC. This case ended in November of 2014 and was tried in the Southern District Court of California. AutoZone Stores catered more towards the male market and (the male dominate) upper management made a conscious effort to make the responsibilities far greater on the existing women in management, in an attempt to weed them out. In this particular case they trumped up allegations of theft, in order to fire Rosario Juarez, after she had already filed a civil suit against the company for pregnancy discrimination. I believe the theory of Deontological Ethics is what is being ignored in this case. The men trusted to make ethical decisions to allow equal opportunity were abusing their positions, putting glass ceilings on women throughout the company, throughout their district. _________________________________________________________________________________________________________________________________ Legal Issue AutoZone Stores LLC was ultimately lost the case as they were deemed guilty of pregnancy-related discrimination, and retaliation. Violating Govt. Code § 12940 and Title 2 of the Cal. Code of Regulations § 7293.7 & 7291.5 P. Wiseman, Berkley Law: Record Punitive Damages set in Juarez v. AutoZone Stores, Inc. Verdict, November 2014 Record Punitive Damages set in Juarez v. AutoZone Stores, Inc. Verdict – The Network (berkeley.edu) _________________________________________________________________________________________________________________________________ Based on your understanding of ethics from the assigned readings, discussions, and lesson, identify the main ethical issues raised by this case. Which ethical theories do you feel are most applicable to this case? How might people with different ethical beliefs view this case? Ethical issues Again, in my opinion gender discrimination is at the core of my case. I also believe that the Deontological Ethics theory is the one that is being ignored, hence making it best suited for this case. To play devils advocate, I could easily see the men running AutoZone, justifying their actions by equating them to the dollars and cents associated with running a corporation on that scale. In essence saying we’re not, not hiring women, because of their gender, we are hiring the gender (men) that is more cost effective (training wise) and more suitable our target consumer. Arnelle Introduction The topic I selected for my case is affirmative action in hiring, evaluation, and promotion. The case I selected was from 2016, the United States Department of Labor (USDOL) VS. Tyson Foods Inc. I chose this case because as a mixed race woman I am questioned a lot about the significance of certain laws or practice in this case Affirmative action. I have heard a lot of conflicting opinions about it and was interested in doing the research to see if this law has served it’s purpose. Some think it should no longer be used as some people believe it creates an unequal amount of opportunity at this point for minorities and women. Some people think it is still not being upheld enough so chose this case to truly see the facts. I think other people should care because at the end of the day everybody wants or should want to be treated fairly. I think people should want the same opportunities as everybody else regardless of race, sex, sexual orientation etc. when it comes to securing a job you are qualified for. The ethical dilemma I think it raises is should minorities and women be given more opportunities in hiring, evaluation, and promotions. Background of the case The United States Department of Labor settled for the sum of $1.6 million dollars due to the labor discrimination allegations that were said to have taken place between 2007 and 2010. Tyson Foods Inc. is federally contracted by the United States government, more specifically it was the department of labors Office of Federal Contract Compliance Programs (OFCCP) that conducted a statistical analysis of six plants in Arkansas, Texas, and New Mexico. The findings were that Tyson had discriminated at various times against minorities and women. The ethical theory I thought was best suited for my case was Utilitarianism or ‘whatever would do most good”. I believe it is hardly anybody’s best interest to discriminate in businesses. Not only will you take opportunities away from a lot of people who were qualified for these positions but you essentially soot yourself in the foot when you cut out the new ideas and perspectives of people with different cultures and backgrounds. This alone is the cause for a drop in the revenue you could have had with innovation. Tyson Foods agrees to resolve race harassment and retaliation lawsuit.
